You may use the Service for personal, non-commercial purposes to track workouts, monitor fitness progress, and access related features. You agree to use the Service in compliance with all applicable laws and regulations.

- Use the Service for any illegal, harmful, or fraudulent purpose

- Scrape, data mine, or use automated tools to access the Service without permission
- Reverse engineer, decompile, or disassemble any part of the Service

- Harass, threaten, or harm other users
- Upload content that is offensive, defamatory, or infringes on intellectual property rights
- Use the Service to distribute spam, advertising, or promotional materials without authorization

5. User Content

You retain ownership of all workout data, progress photos, and other content you create or upload ("User Content"). By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely to provide and improve the Service.
5.2 Content Standards
You represent and warrant that your User Content:
- Does not violate any applicable laws or third-party rights
- Does not contain offensive, defamatory, or inappropriate material
- Does not infringe on intellectual property rights of others
- Is accurate and not misleading
5.3 Content Removal
We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice. We are not responsible for monitoring or reviewing all User Content, but we may do so at our discretion.
6. Intellectual Property Rights

If you provide feedback, suggestions, or ideas about the Service, you grant us an unrestricted, perpetual, royalty-free right to use, modify, and incorporate such feedback without compensation or attribution.
7. Subscription and Payments
7.1 Free and Paid Services
1RM.fit offers both free and paid subscription tiers. Free users have access to basic features, while paid subscribers ("Pro" users) unlock additional premium features.
7.2 Subscription Terms
Paid subscriptions are billed on a recurring basis (monthly or annually) until canceled. By subscribing, you authorize us to charge your payment method for the subscription fee and any applicable taxes.
7.3 Billing and Renewal
- Subscriptions automatically renew at the end of each billing cycle
- You will be charged at the then-current subscription rate
- We will notify you of any price changes in advance
- Your subscription continues until you cancel
7.4 Cancellation and Refunds
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial subscription periods, except as required by law or at our sole discretion.
7.5 Free Trials
We may offer free trial periods for paid subscriptions. If you do not cancel before the trial ends, you will be automatically charged for the subscription. You may only use one free trial per account.
8. Third-Party Services and Links
The Service may contain links to third-party websites, applications, or services that are not owned or controlled by 1RM.fit. We are not responsible for the content, privacy policies, or practices of any third-party services.
We may integrate with third-party services (e.g., Google Sign-In, payment processors) to enhance functionality. Your use of these services is subject to their respective terms and policies.
You access third-party services at your own risk.
9. Disclaimers and Limitation of Liability
9.1 Health and Fitness Disclaimer
IMPORTANT: 1RM.fit is a fitness tracking tool, not medical advice.
The Service is designed to help you track workouts and monitor progress. It does not provide medical, health, or fitness advice. Before starting any exercise program, you should consult with a qualified healthcare professional, especially if you:
- Have any pre-existing medical conditions
- Are taking medication
- Are pregnant or nursing
- Have not exercised regularly in the past year
By using the Service, you acknowledge that you are participating in physical activities at your own risk. We are not responsible for any injuries, health issues, or damages resulting from your use of the Service or participation in exercise.
9.2 Service Availability
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that:
- The Service will be uninterrupted, secure, or error-free
- Defects will be corrected
- The Service is free from viruses or harmful components
- Results from using the Service will be accurate or reliable
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1RM.FIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.
10. Indemnification
You agree to indemnify, defend, and hold harmless 1RM.fit, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your User Content
- Your violation of any third-party rights
11. Modifications to the Service
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the Service without liability.

12. Termination

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.

Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.
13.3 Class Action Waiver
You agree that disputes must be brought on an individual basis only, and not as part of any class or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
13.4 Exceptions
Either party may seek injunctive or equitable relief in court to protect intellectual property rights or confidential information without first engaging in arbitration.
14. Miscellaneous
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and 1RM.fit regarding the Service and supersede any prior agreements.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
14.3 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
14.4 Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms without restriction.
14.5 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, or internet outages.
15. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will:
- Update the "Last Updated" date at the top of this page
- Notify you via email or in-app notification (for material changes)
- Provide a reasonable notice period before changes take effect
Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and delete your account.
